    POST-ADOPTION COUNSELING

The Open Record editor received an e-mail from Australia, from Evelyn Robinson, MA, Dip Ed, BSW, author of Adoption and Loss - The Hidden Grief, offering "one-to-one [international] counseling services relating to grief, adoption, gambling and other personal issues... I am a qualified social worker and member of the Australian Association of Social Workers..."
     Curious, I asked Evelyn the following:
     "Are you branching out to the USA?  Any response from here?  Do you find that many adoptees, parents and/or adopters have need of counseling "down under"? Is adoption being phased out as a "last resort in Australia?  Has New Zealand Parliament raised any new adoption issues yet? What seems to be the most common problem of the adoption affected?"....
     Here's Evelyn's reply (on June 15, 2003):
     "Actually my first customer is in the US! Some people find it hard to locate professionals who are aware of adoption issues and would prefer to have counselling by phone with someone they have confidence in than meet in person with someone they have no confidence in!  There is certainly a great need for counselling here and the authorities seem to disregard adoption issues because there are so few adoptions nowadays. Last year in South Australia there was only one.
     I deal mostly with reunion issues and my second book, which I'm working on, is going to be about reunion. I haven't heard anything new from New Zealand recently. In Western Australia they have pretty much abolished the veto system which is good."

New Zealand's adoption boss is under fire for opposing adoption.
     With officials preparing for changes to adoption law, Social Services Minister Steve Maharey has received a complaint from a pro-adoption lobbyist about Child, Youth and Family adoption services general manager Mary Iwanek.
     The complaint criticises her "outrageous" comments, saying she is "driven by a personal agenda based on her own experiences."
     Iwanek is quoted in The Open Record newsletter on an American adoption website, saying she was working to abolish adoption.
     "I discovered there are always more things to do [like working for adoption change altogether -- doing away with it would be lovely].
     "Then there's the whole issue of birth technology and surrogacy to tackle.  We are just starting that, as well as trying to stop inter-country adoption, etc. etc etc.  So brace yourself," she said.
     Americans For Open Records president Lori Carangelo, the newsletter's editor, said the comments were from a letter "some years ago" but Iwanek had authorized its republication in late 2001.
     But Iwanek's boss, social work general manager Ken Rand, said the publication of the quotes had not been authorized, were out of context, and Iwanek had asked that they be removed from the website.
     Parliament's social services select committee is understood to have asked for a briefing from Iwanek about adoption law, after the government administration committee was last year unable to agree on recommendations.
     National's social services spokeswomen Katherine Rich said if Iwanek had authorized the publication of such views, she would have to stand down.
     "These views cannot be reconciled with her role as head of adoption services." she said.
     Rand said CYF supported Iwanek's views.  "She said she hopes to work towards a future where the adoption of children should no longer be necessary, so we have a society where all children are able to be cared for by their own parents but also acknowledge the fact that in any society there will always be children who will need to have alternative permanent care."
     Carangelo said many social workers were forced to work within the system for change, secretly slipping information to anti-adoption activists, though she did not suggest Iwanek was leaking information.
     She said adoption should be abolished in favour of legal guardianship arrangements, because adoption created a lie that was emotionally damaging to the children.
     New adoption laws being prepared are expected to address perceived discrimination in adoption and tighten up the rules around international adoption to limit "abuse" by New Zealand parents.

    With regard to Jonathan Milne's otherwise fine reporting in "CYFs Manager Slammed as Anti-Adoption" (5-18-03), I have been misquoted.  I can understand the confusion.  He correctly reported "Americans For Open Records president Lori Carangelo, the newsletter's editor, said the comments were from a letter some years ago" -- which is also stated in the subject newsletter, but the rest of that sentence is untrue -- I did not state to Mr. Milne nor to anyone that "Mary Iwanek had authorized its republication in late 2001."
     Regarding "Carangelo said many social workers were forced to work within the system for change, secretly slipping information to anti-adoption activists, though she did not suggest Iwanek was leaking information" --I understand your limitation of space, but this is an incomplete and misleading quote.  I specifically referred to sympathetic U.S. social workers leaking names to adoption searchers, due to non-uniform disclosure laws from state to state.  The resulting reunions often revealed abuses by the system that are of interest to "anti-adoption activists";  we don't have a pipeline via social workers to crimes covered up by sealed records.
     But the problem, of course, is not the Star-Times' reporting, in which you quote Katherine Rich: "These views cannot be reconciled with her role as head of adoption services."  The problem is that Ms. Rich believes it's in CYF staff's best interest to perpetuate family separations via adoption, to assure their jobs, rather than to assure "children's best interests."  I suspect that if CYF terminates Mary over a speculative comment about the future of adoption, it's because she is effectively lobbying for children rather than for her own job security, and therefore has our support.

    AmFOR's new worldwide Donor Offsping/Donor Parent Registry already has its first 100+ registrants and has attracted interest of U.S. and foreign press seeking stories to support an international effort to provide disclosure to Donor Offspring. Worldwide, it is estimated that less that only 25% of donor offspring have even been informed that they have a donor parent.
     In the U.K., however, disclosure of both the truth of one's conception as well as identity of the donor parent may soon become law.  Under the Children's Act in the United Kingdom, children's interests are paramount.  In the U.K., adult adoptees are permitted their true birth certificates, but over 30,000 donor offspring in the U.K. are not permitted disclosure as to the identity of their donor parent.
  The basic ethical and legal issues, which are also of enormous interest to American adoptees as well as American donor offspring, concerns the right not to be deceived or deprived of essential information about one's own history and "using" a child for the ends of the parents to conceal infertility.                 In New York recently a group of families successfully filed a class action suit against New York CPS. This is the first recorded group action against CPS in my Lois Law....I would like to get together some class action against the State of California CPS. Michigan's Top Court Admits Case Was Tough

A 5-year-old boy must be removed from his adoptive parents and returned to his Grand Rapids area birth mother, who last cared for him when he was a 16-month-old toddler, the Michigan Supreme Court ruled Tuesday in what it called "an imperfect decision"     with heartbreaking implications.
     In a 6-0 ruling, the court said Kent County Probate Judge Patricia Gardner "clearly erred" when she terminated Melissa Kucharski's parental rights in March 2001 based largely on a therapist's one-hour assessment of an alleged attachment and bonding     problem between the mother and child.
     "I'm excited, pretty happy, kind of anxious," Kucharski said Tuesday evening. "I knew in my heart that if the right person heard my story, they'd know that I was done wrong, that it would turn out the way it did." The decision invalidates the boy's adoption. The court ordered the state Family Independence Agency to begin efforts to reunite the mother and the boy, Jacob, who has spent about three years with foster parents who later adopted him.
     The adoptive parents, John and Deb Wordhouse of Grand Rapids,seemed shaken when a reporter talked to them Tuesday evening at their home. They had no comment before talking to their lawyer.
     The issue recalls the wrenching and hotly debated Baby Jessica custody case of 1993, when courts ruled to take the 2-year-old from her Ann Arbor adoptive parents and give her to her Iowa birth parents.
     In a telephone interview from her Wayland home Tuesday evening, Kucharski said she was a 16-year-old student in Grand Rapids when she became pregnant.  She said she had a marijuana problem but conquered it long before she lost her parental rights to her son when she was 19.
    Since then, she has bought a house with her fiance, Derrick Rademaker. The couple have an 18-month-old son, Elijah, and a bedroom waiting for Jacob. She said she left it undecorated so Jacob can help pick the furnishings.
    She and Rademaker both work at a Grand Rapids cookie factory. The couple plan to wed, and want Jacob to be in the wedding, but she said they were waiting for the legal issues around Jacob's adoption to end.
     "If he does remember me, it will be the best day of my life," Kucharski said. "If he doesn't, that's going to be a little harder. But I think that he's going to transition        just fine." In Tuesday's opinion, the court said Gardner seemed unduly influenced by the relative wealth of the adoptive parents, who also had been the child's foster parents, and wrongly terminated Kucharski's parental rights.
    The child was 16 months old in April 1999 when he was taken from his mother because of her marijuana use. The boy was placed in a foster home, while the mother
entered an inpatient treatment program.
    After some initial problems, Kucharski got good reviews from social workers, a therapist and a psychologist about her progress in beating the drug problem, and in      her interactions with her son. But one therapist, after a one-hour session with the mother and son, said the two didn't bond well.
    Even that therapist acknowledged that "the mother had appropriate housing and employment, was able to care for herself, had completed an independent-living              program and remained drug-free for over one year," the court said.
    The therapist, Yvwania Richardson of Flint, testified that she was concerned about the boy's speech development and responsiveness to Kucharski.
     Kucharski's lawyer argued that the boy's problems were the result of a hearing impairment. Once the boy had his tonsils removed and tubes placed in his ears in
January 2002, his vocabulary skyrocketed, the lawyer said.
     Richardson declined to discuss details of the case Tuesday.
     "I've got 30 years of experience. I stand by my report," she said. Lora Holewinski of Grand Rapids was the Catholic Social Services caseworker who helped place Jacob with his adoptive family.
     She said Kucharski lost the custody of the boy not only because of a drug problem, but also because she had poor parenting skills.
     "One of the reasons he came to us was because of a lack of attention by the mother," said Holewinski, who no longer works for the agency. "She would leave him
in a playpen for hours on end."
     She said Kucharski moved out of the county to have her second child because she was afraid he would also be taken into foster care.
     Of the court decision, Holewinski said, "it's just going to destroy Jacob. I don't think the government understands the attachment issue. I just feel so bad for Jacob and his adoptive parents."
     The court said Kucharski "fulfilled every requirement" authorities put before her to regain custody of the boy.
     "The fundamental right of a parent and child to maintain the family relationship can be overcome only by clear and convincing evidence, which, in this case, was not supplied by this single witness," the court said.
      The court said Gardner appeared to be wrongly and unduly influenced by the relative advantages of the adoptive home compared to the mother's home.
      Gardner could not be reached for comment Tuesday evening.

         "As an attorney I view the current laws in this country regarding adoption as reprehensible for the most part. Everyone should have the right to know who his or her biological parents are. No one should be subjected to being taken away from one's      biological parent due to the biological parent being in a stressful situation when a child is born and pressured by social workers to give up all parental rights to the child. Nor should any child be subjected to being given to an infertile couple who most likely see prospective adoptees as little more than commodities available to meet the adoptive parents' desires. Adoption law reform is long overdue."

o  ADOPTSPEAK BOOKS, WORKSHOPS FAIL TO UNTANGLE WEB

     The saying "What a tangled web we weave when first we practice to deceive" applies to adoption.  Attempts to untangle the web of adoption lies via books and workshops approved by adoption agencies and written by pro-adoption authors are further entangling those in the web.
     Author Rozanne Nathalie's intentions may have been lofty when she wrote simplistic children's books to aid people in explaining to children that they were conceived through in vitro fertilization, egg donation, surrogacy, or were placed with them through adoption.  Some books geared to their age level could be helpful, but most helping professionals agree that it's best for the child's mental health not to lie about the child's parentage or manner of conception.  Nathalie's site at http://www.TellYourChild.com not only excuses those who may choose "not to tell", but also her books encourage those who do tell to opt for a "special child" (chosen child) terminology that is more difficult for the child to conceptualize than the plain truth.  "Special child" places emphasis on the child being "different" yet at the same time Nathalie alleges "there's no difference at all" between adoptive families and traditional families.  Regarding adoption, for instance, Rozanne Nathalie wrote:
     "Adoption is probably the most socially recognized and understoodunconventional family building process. Yet for parents, approaching this subject with their children can often times be a difficult task. Special Delivery deals with the issue of adoption from the perspective of loving parents going on a quest to find their baby and which ultimately results in a "Special Delivery," and the fulfillment of their dream,their child"...."You were created from both of our parts, you know, but we needed to find you a warm place to grow.....Some babies come from their mommy's body, and others certainly do not. And it really makes no difference at all, because love is what ties the knot."
  Yes, Rozanne, there are serious differences.  And that is why there are a large number of books and workshops by helping professionals featured by North American Council on Adoptable Children (NACAC) in their August 6-9-03 conference registration booklet--books and workshops that attempt to address adoption issues:   "Struggle for Identity: Issues in Transracial Adoption," "Attachment Issues in Children from Infancy to Teens,"  "Medical Issues in International Adoption,"  "Consumer Mentality and Adoption:  Families with Shopping Lists," "Living with an Angry Child," "A Workshop for Transracially Adopted Adults:  Love is Not Enough," "Telling the Truth to Your Adopted Child:  Making Sense of the Past," "What About Me? Helping Parents After Disruption," "The Emotional Roller Coaster of Search," etc.
     NACAC's newsletter features photos and profiles of children available for adoption--most of whom are on medication for "ADHD" and "attachment disorders."  The Child Welfare League's book catalog contains page after page of books that profess to explain and solve the serious emotional problems of adoptees.   Then there are the large number of books at Bill Gage's website, "A Reader's Guide to Adoption-Related Literature" at http://members.aol.com/billgage/lit-list.htm that document personal situations and complexities of the least understood family building process of stranger adoption and secret origins.
     The parental anonymity inherent in sperm and egg donor assisted conceptions is no less complex for a donor offspring to deal with than for adoptees.  All the sugar-coated, politically correct AdoptSpeak terminology is not going to change that. Instead of trying to brainwash the child to accept a fantasy of being "no different," wouldn't it make more sense for adults to accept and deal with the differences, or not create the unnatural situation in the first place?

From January 1989 through Christmas 1998, the photo-print edition of The OPEN RECORD was distributed free of charge nationwide and in Canada to adoption organizations, adoption affected individuals, lawmakers and agencies.  The first electronic issue of The OPEN RECORD went online in 2001.  It is now being distributed worldwide and back issues (back to our first issue in 1989) are accessible online at
